Terms of Service

1. Acceptance of Terms

By creating an account or using PrayerWise, you acknowledge that you have read, understood, and agree to these terms.

2. Eligibility

• You must be at least 13 years old to use the Services
• By using the Services, you represent that you meet this age requirement and have the legal capacity to enter into these Terms

3. Account Responsibilities

You may need to create an account to access certain features. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities under your account

4. Permitted Use

You may use the Services only for lawful purposes and in accordance with these Terms.

Prohibited Activities:

• Violating any laws or regulations
• Transmitting spam, malware, or harmful code
• Interfering with or disrupting the mobile applications or services
• Reverse-engineering, copying, or modifying our AI models or mobile application technology
• Using the Services to impersonate others or spread false information
• Excessive or abusive usage that may impact app performance

5. User Content

• You retain ownership of content you submit ("User Content")
• By submitting User Content, you grant us a worldwide, royalty-free, perpetual license to:
  • Use, store, and process it to provide and improve the Services
  • Generate anonymized insights for AI training (unless opted out)
• You are solely responsible for your User Content
• We may remove any User Content that violates these Terms

6. Intellectual Property

• All content, trademarks, code, and technology in the mobile applications and website are owned by PrayerWise or its licensors
• You are granted a limited, non-transferable license to use the Services for personal use
• You may not copy, modify, distribute, or create derivative works without written consent

7. Payments & Subscriptions

• Some features require payment through the Apple App Store or Google Play Store
• All payments are processed by Apple or Google according to their terms and policies
• Subscriptions are managed through your App Store or Google Play account
• Subscriptions auto-renew unless canceled through your app store account
• Refunds are subject to Apple's and Google's respective refund policies
• We use RevenueCat to help manage subscription status but do not process payments directly

8. Termination

We may suspend or terminate your access at any time, with or without cause or notice, including for:

• Violation of these Terms
• Fraudulent or abusive behavior
• Non-payment

Upon termination, your right to use the Services ends immediately.

9. Disclaimer of Warranties

Express or implied warranties include but are not limited to:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY OR RELIABILITY OF AI OUTPUTS
• NON-INFRINGEMENT

We do not guarantee the Services will be uninterrupted, secure, or error-free.

10. Limitation of Liability

• WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (OR $100 IF NO PAYMENT)

11. Indemnification

You agree to defend, indemnify, and hold harmless PrayerWise its officers, and employees from any claims, damages, or expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your User Content

12. Governing Law

• These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles
• Any disputes will be resolved in the state or federal courts of Delaware

13. Changes to These Terms

• We may update these Terms. Changes will be posted here with a new "Effective Date"
• Continued use of the Services after changes means you accept the new Terms
